Terms and Conditions
1. DEFINITION AND SUBJECT MATTER OF THE CONTRACT
This agreement (hereafter defined as “Contract”), as a distance contract, is disciplined by the art. 50 of the Legislative Decree 6 September 2005, n. 206 (“Consumer Code”). The present constraining negotiation has as its object the selling of personal properties between ELODIE di Francesca Mantovani e Giulia Lodia SNC(“Seller”) and the consumer (“Client”). The contract is intended to be directly concluded with the acceptance by the Client of the proposal of sale issued by the Seller by phone or through the site www.elodiebrides.com (“website”).
The present Sales Terms (“Sales Terms”) and, in particular, the information referred to in the art. 59 of the Consumer Code, will remain good and effective until there won’t be any modifications and/or integrations made by the Seller. Possible modifications and/or integrations to the Sales Terms will be effective from the date on which they’ll be communicated to the public and will be applied to the sales carried out from that date on. The latest version of the Sales Terms is the one available on the site.
The Client asserts and attests: (i) to be a consumer as laid down in the art. 3 of the Consumer Code; (ii) to be of legal age; (iii) that the details given for the performing of the contract are correct and true.
2. THE OFFER
The Seller, through its website sells:
- dresses and gowns: made-to-measure, handcrafted only upon order, and in stock. Available in standard or customized sizes
- accessories: made-to-measure, handcrafted only upon order, and in stock.
Made to measure dresses and gowns are crafted on the basis of measurements provided by the Client in the area “Custom”. The Client is accountable for the measurements inserted in the above mentioned area. The Vendor is not responsible for any imperfections/defects related to wrong information provided by the Client on the Site through the“Custom” form.
For any help or doubt regarding measurements and how to take them the Client can follow the tutorial video, contact the customer care by email: email@example.com or by chat. The Seller will reply by the following 48 hours.
The Seller constantly invests in the photographic representation of its products, nevertheless, due to the digital rendering of images on the net, different light settings of screens or other external factors, online product representation may not be completely compliant with reality. By proceeding with the purchase, the client accepts that there might be small discrepancies.
The prices of the products shown on the Site and/or through other eventual remote sales systems of the Vendor include VAT and any other tax. On top of the price of the product, at the end of the purchase process, there could be the addition of the shipping costs, based on the final shipping address and/or the product/s purchased.
For international shipping Customs fees are not included, and are charged to the Client. Custom fees amount depends on destination Country and order value.
4. METHOD OF PURCHASE AND PAYMENT
The Contract is finalized at the time of the payment. Once the order is completed the client receives the order confirmation with details of: each product/s purchased, order total amount (customs fees excluded), price of each product, delivery terms and time.
The client has 24h to rescind from the contract obtaining in doing so the complete refund of the amount paid, without any penalties and without having to specify the reason. In order to rescind from the contract the client should write to firstname.lastname@example.org
After 24h it won’t be possible to rescind from the contract anymore.
The Client can choose one of the following payment methods: credit card, prepaid card, Paypal, wire transfer, or any other payment method that the Seller expressly accepts on its website.
In case of wire transfer the payment should be processed within 2 days from the order, addressed to:

Bank transfer reference: order number and date.
5. SHIPPING&DELIVERY TERMS
Delivery times are specified at the time of purchase, according to the type of product selected – ready to ship or made to order – and destination.
The Client can follow the status of the order by accessing the personal area on the Site.
In any case the Seller is bound to delivery times. Delivery times might be subject to delays due to majeure forces. Any variation to the delivery date will be promptly communicated to the Client.
At the time of the dispatch , the Client will receive an email containing the tracking number necessary for monitoring the delivery.
If the Client doesn’t receive the goods or the shipping is delayed the Client should contact customer care at email@example.com adding order number as email subject.
In case of delivery destinations outside the European Union, customs fees will be paid by the client/recipient of the goods.
The client or the recipient of the Product, upon delivery, should check product/s integrity, quality and type. If the client harbors any doubts about product/s integrity, should indicate it on delivery receipt: indicating reservation in writing because the package is damaged or refusing to accept delivery handing it over to the courier which has delivered it in the first place.
6. LEGAL WARRANTY
All goods sold by the Seller are covered by a 2-year warranty for lack of conformity, pursuant to articles 128 and following of Title III of Legislative Decree 206/2005. To take advantage of the guarantee, the Client is required to show the invoice, or the payment receipt, indicate in a specific and contextual way the good for which the application of the legal guarantee is requested (for this purpose it is sufficient to mention the description or indicate the product code entered on the receipt / invoice) and if he/she wants to request repair, replacement or refund. The Client, under penalty of forfeiture, is required to report the lack of conformity within and no later than 2 months from the discovery of the defect itself. The guarantee will be valid and effective as long as the goods have been used correctly, according to the intended use and in compliance with the instructions for use and washing contained in the label of the goods or, in any case supplied together with the goods. If the Seller finds any conformity defects, will guarantee their restoration, repair or replacement without charge, undertaking to pay the costs of returning the goods to the Client. In the event that, for any reason, it is not possible to restore the conformity and functionality of the goods by repair or replacement the Client will be entitled to a reduction of the purchase price or to the termination of the contract with return of the entire amount paid.
The client has 24h to rescind from the contract getting a full refund of the amount paid without any penalty and without having to specify reasons. In order to rescind from the contract the client should write to firstname.lastname@example.org
7.1 STANDARD SIZE DRESSES AND ACCESSORIES
Client, who has purchased a Standard accessory or dress (where standard dress means a dress purchased in sizes from 38 to 46), has a period of fourteen days, which will start to run from the day of the delivery of the Product, to withdraw from the contract, without having to provide any reasons and without having to pay any penalty.
The right of return does not apply to the supply of goods custom made or clearly personalized and therefore, for made-to-order dresses/accessories, as by art.59 of Consumer Code.
The Customer of a standard Product can proceed with the return of the product/s purchased by accessing his personal area and following the procedure:
- enter personal account on the website
- select the Returns section
- enter registration email address and order number related to the product/s to be returned
- select the item/s to be returned
- select the reason for it
- select preferred refund method
- select method of sending the return back: collection organized by the Seller or courier selected by the Customer
Once the procedure is completed and eligibility for return confirmed, the customer will receive a confirmation email from Seller containing the shipping label (in case of choice of collection organized by the Seller) and the instructions to be followed in order to return the goods.
Once procedure is completed and the return accepted the Client will receive an email with shipping label and instructions for delivery.
In case of returns due to wrong or faulty products shipping costs are free of charge, in any other case shipping costs will be deducted from the refunded amount, .
In any case customs fees will be reimbursed.
To be accepted by the Seller, the Product must be in original condition, free from wear and tear, make-up, abrasion or stains and must not have been worn, altered or washed. Any label must be left attached. Furthermore, the Product must be returned in the original packaging.
All the Products will undergo a further quality control upon return: the Product integrity and authenticity will be verified. The Seller will refund the price within 10 working days from the approval of the return request. If, for any reason, the Product does not meet the requirements for the return, the same will be returned to the Client, with debit of the shipment and the price of the Product paid by the Client will not be refunded.
The refund will be made using the same payment method used for the purchase, unless the Client expressly agrees otherwise and will be equal to the amount paid minus customs fees, if any. Please note that time for re- crediting the amount may varies according to bank account and payment methods (credit cards may take up to 30 days)
The Client is responsible for the loss or damage of the Product until the actual redelivery to the Seller.
Please note that the Products are handcrafted and, therefore, any small imperfections, color nuances, streaks are not to be considered defects / faults, but rather typical aspects of a natural product of Italian manufacture.
7.2 MADE TO ORDER DRESSES AND ACCESSORIES
Elodie Brides made-to-order dresses are manufactured specifically for each customer in accordance with the information provided when the order is placed (by filling the “Insert your measurements” form). The Seller’s mission is to provide the perfect dress, however it might happens:
- Manufacturing defects – internal quality control are manually and individually taken on every garment although imperfections may occasionally go unnoticed;
- Non-compliance with the order – tailored made size does not correspond to client’s own measurements
The seller assumes full responsibility for resolving the above issues at no extra charge. Depending on the type of the problem the seller will either alter the dress if possible, or manufacture a new one. In any event, the customer will not be charged.
Considering customized dresses are made especially for Client’s size ranges and height the Seller is unable to offer returns (art. 59 of the Consumer Code), so no refund will be issued.
To request assistance the Client should write to email@example.com with a description of the problem and order number as email’s subject. Depending on the type of problem, our tailoring team will decide how to proceed.
Assistance can be requested if the dress has not been worn or washed unless otherwise stated by our customer care team and in any case by 14 days from delivery date.
8. PERSONAL DATA PROCESSING
The personal data provided by the Customer will be processed in conformity with the provisions of European Regulation 2016/679 and its subsequent amendments and additions. For this purpose, the Seller provides the Client with a notice to this effect which is always available on the Website.
9. PLACE OF JURISDICTION
The Contract is under the jurisdiction of the Italian Law. Any controversy related to the application, execution, interpretation and violation of the Contract will be under the jurisdiction of the Court of Milan.
- Alternative dispute resolution
In the rare case of unsolved complaints between ELODIE di Francesca Mantovani e Giulia Lodia SNC and the Client, the Seller highlight that from January 9, 2016 there is an online platform where the client can find the list of organisms to which turn to open an online dispute resolution procedure.
